Conditions of Sale

1. Application

These conditions govern every sale by Vining Fine Art, a company registered in the State of California, whether concluded by correspondence, by telephone or through this website.

2. Prices and offers

Prices are stated on each catalogue entry in United States dollars and include packing; carriage and any applicable sales tax are quoted separately. The prices of gold pieces are reviewed when the price of gold moves. We reserve the right to alter any price at any time before a sale is confirmed. Nothing on this website constitutes an offer capable of acceptance; a contract of sale arises only upon our written confirmation, and the price on our invoice is the one that applies.

3. Payment, title and risk

Payment is due in full before despatch, by major credit card or by bank transfer in United States dollars. Title passes on receipt of cleared funds; risk passes on delivery.

4. Reservations

A piece will be held for seven days without charge while a decision is reached. Longer reservations are by agreement and may be subject to a deposit, which is refundable save where the buyer withdraws after the reservation period has been extended twice.

6. Delivery and returns

Governed by Delivery & Returns, which likewise forms part of these conditions.

7. Limitation of liability

Nothing in these conditions excludes liability for fraud or fraudulent misrepresentation, or any liability which cannot lawfully be excluded. Subject to that, our total liability in respect of any piece shall not exceed the price paid for it.

8. Governing law

These conditions are governed by the laws of the State of California, and the courts of that State shall have exclusive jurisdiction in respect of any dispute arising under them.
